“Agreed to” has to be proven by an exchange of monetary or other agreed to consideration in order to support a valid prostitution charge.

Violations of the above are usually considered to be misdemeanors with up to $1,000 in fines and as much as six months in jail, or both. Multiple prostitution convictions bring stricter penalties, which could include more minimum jail time and heftier fines. Driver’s license suspension could occur if the judge finds the prostitution occurred in a vehicle within 1,000 feet of a residence. That suspension could be as long as 6 months.
